Alamance County Speeding Tickets | Improper Equipment

From time to time we get a call from someone who got a speeding ticket in Alamance County and really had something wrong with their speedometer. Many times they will already have had the problem repaired. Other times they are thinking about it but are not sure what to do.

In 2004 the legislature amended the speeding statute to provide that the charge of improper equipment, i.e. broken speedometer, was a lesser included offense of the charge of speeding. This was intended to make it easier to plea bargain a speeding charge, which carries insurance points, to a charge of improper equipment, which carries no insurance points. However, in Alamance County, for a long time the amendment to the law had very little practical effect. The District Attorney’s speeding ticket policy in Alamance County does not permit for negotiated pleas of improper equipment when the original charge is speeding.

Recently, there’s been a change to the District Attorney’s policy concerning improper equipment. It is now possible to have your charge amended to improper equipment in some circumstances.
